In 1978, Congress enacted the Electronic Fund Transfer Act. The Act establishes the basic rights, liabilities, and responsibilities of consumers who use electronic fund transfer services and of financial institutions that offer these services, such as The Geo. D. Warthen Bank. The Board of Governors of the Federal Reserve System issued Regulation E to implement the Act. Regulation E requires The Geo. D. Warthen Bank to disclose to our customers the terms and conditions of our electronic fund transfer services as set forth in the disclosure below. The Geo. D. Warthen Bank reserves the right to change the terms and conditions of our electronic fund transfer services upon prior written notice to you.
The disclosure statement uses the terms "Electronic Fund Transfer" or "Electronic Transfer". Within the context of The Geo. D. Warthen Bank operations and this disclosure, these terms mean any transfer of funds other than a transaction originated by check, draft, or similar paper instrument, that is initiated through an electronic terminal or by a preauthorized debit or credit and/or preauthorized credits. The term does NOT include balance inquiries or payments made by check, draft, or similar paper instrument at an electronic terminal.
Portions of this disclosure are being made in compliance with Section 205.7 of Regulation E.
Liability Disclosure
Tell us AT ONCE if you believe your GDWB card has been lost or stolen. Telephoning is the best way of keeping your possible losses down. You could lose all the money in your account. If you tell us within 2 business days, you can lose no more than $50.00, if someone used your card without your permission.
If you do NOT tell us within 2 business days after you learn of the loss or theft of your card, and we can prove we could have stopped someone from using your card without your permission if you had told us, you could lose as much as $500.00
Also, if your statement shows transfers that you did not make, tell us at once. If you do not tell us within 60 days after the statement was mailed to you, you may not get back any money you lost after the 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time.
If a good reason such as a long trip or hospital stay kept you from telling us, we will extend the time periods.

Disclosure of Types and Transfers
- Direct deposit of any government payment.
- Preauthorized debits from an account belonging to someone else.
- Preauthorized credits from an account belonging to someone else if you have arranged to have direct deposits made to your account at least once every 60 days from the same person or company, you can call us at (478) 552-6906 to find out whether or not the deposit has been made.
You may use your GDWB ATM/Debit card and personal identification number to:
- Get checking and savings account information
- Make deposits to checking and savings accounts
- Get cash withdrawals from checking accounts
- Transfer funds from checking to savings, from savings to checking, from checking to checking, or from savings to saving.
- Make loan payments with us
- Point of sale Transactions: use checking account to purchase goods or pay for services in person by phone, or by computer. Also get cash from merchant if merchant permits
Limitations on Frequency or Dollar Amounts of Transfers
You may make any number of cash withdrawals. The maximum cash withdrawal at any one transaction is $375.00. The maximum daily cash withdrawal at an ATM is $375.00 and the maximum daily transaction limit at a POS terminal is $1,000.00. There is no limitation to the number of deposits, payments, transfers or balance inquiries.
Transfer Charges
The Geo. D. Warthen Bank will charge your account on a monthly basis for preauthorized debits and/or credits according to our service charge schedule in existence.
Liability for Failure to Make Transfers
If we do not properly complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance:
- if, through no fault of ours, you do not have enough money in your account to make the transfer; or,
- if, the GDWB machine where you are making the transfer does not have enough cash; or
- if, the GDWB machine where you are making the transfer was not working properly and you knew about the breakdown when you started the transaction; or,
- if, circumstances beyond our control (such as fire or flood) prevent the transfer; or,
- if, you had previously reported a lost or stolen card or unauthorized transaction on the account; or,
- there may be other exceptions stated in our checking and/or savings account agreement with you.
Terminal Transfers
You will get a receipt at the time you make any electronic transaction to or from your account using one of our GDWB machines.
Account Information Disclosure
We will disclose information to third parties about checking and/or savings account or the electronic transfer you make: (1) when it is necessary for completing transfer; or (2) in order to verify the existence and condition of your account for a third party, such as a credit bureau or merchant; or (3) in order to comply with government agency or court orders; or (4) if you give us your written permission or as explained in the separate Privacy Disclosure.
Notice of Varying Accounts. If these regular payments (preauthorized debits) may vary in amount, the person you are going to pay will tell you 10 days before each payment, when it will be made and how much it will be.
Periodic Statements. You will get a monthly checking account statement. You will get a monthly savings account statement unless there are no transfers in a particular month. In any case, you will get the statement at least quarterly.
Stop Payments
If you have told us in advance to make regular payments (perauthorized debits) out of your account, you can stop any of these payments. Call us at 478-552-6906 or write us at The Geo. D. Warthen Bank, P.O. Box 637, Sandersville, GA 31082, in time for us to receive your request three business days or more before the payment is scheduled to be made. If you call, we may also require you to put your request in writing and get it to us within 14 days after your call. We will charge $18.00 for each stop payment order you give.
Failure to Stop Payment
If you order us to stop one of these payments (preauthorized debit) 3 business days or more before the transfer is scheduled, and we do not do so, we will be liable for your losses or damages.
In Case of Errors or Question About Your Electronic Transfers

Contact us as soon as you can if you think your statement is wrong or if you need more information about an electronic transaction on your statement. We must hear from you no later than 60 days after we sent the first statement on which the error or problem appeared.
- Tell us your name and account number.
- Describe the error or transfer you are unsure about, and explain as clearly as you can why you believe there is an error or why you need more information.
- Tell us the dollar amount of the suspected error. If you tell us orally, we may require that you send us your complaint or question in writing within ten business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to forty-five days to investigate your complaint or question. If we decide to do this, we will recredit your account within ten business days for the amount you think is in error, so that you will have the use of the money during the time it takes to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten business days, we may not recredit your account.
We will send you a written explanation within three business days after we finish our investigation. You may ask for copies of the documents that we used in our investigation.
GDWB Card
The card is the property of The Geo. D. Warthen Bank and you are required to surrender the card upon request.
